Identify the property<\/h5>\n<p class=\"text-justify text-secondary\">First of all, identify the plot where you plan to construct the building. Consult your architect and prepare a\nsketch that complies with the Kerala Municipality Building Rules (KMBR) or Kerala Panchayat Building Rules (KPBR) according to the jurisdiction under\nwhich your property falls.The sketch should include the following details:<\/p>\n\n<div class=\"mb-4 li-data\">\n<ul>\n \t<li>Site layout<\/li>\n \t<li>Building elevation<\/li>\n \t<li>Sections<\/li>\n \t<li>Site plan (plot width, setbacks, access road width)<\/li>\n \t<li>Floor plan (all floors)<\/li>\n \t<li>Roof or terrace plan<\/li>\n \t<li>Details of septic tank and soak pit<\/li>\n \t<li>Location plan<\/li>\n<\/ul>\n<\/div>\n<p class=\"text-justify text-secondary\">An application for a building permit in Kerala should also cite details like Site location, whether the\nproperty is for Residential or commercial use, An Index of all drawings submitted, Number of sheets, Date, Names of Draftsman &#038; Reviewer,\nScale, Location details including details of Village\/Thaluk\/District, Survey number and resurvey number of the property, Ward number, Extent\n(in arcs and cents), Proposed building area, Plinth and carpet area of all floors, Plinth and carpet area of the car porch, Total area, Coverage,\nFAR (Floor Area Ratio is calculated as the ratio of the Total floor area on all floors to The Plot Area), Permit area, Joinery schedule etc.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold pb-4\">2. Get documents up-to-date<\/h5>\n<p class=\"text-justify text-secondary\">While the Architect works on Step 1, you should also get the following documentation related to\nthe property up to date<\/p>\n\n<div class=\"mb-4 li-data\">\n<ul>\n \t<li><i><b>Possession certificate<\/b><\/i><br class=\"\"> (This is an online document) &#8211; Possession certificate is a document which a property seller gives to a buyer\nstating the possession date of the property. Possession certificate is issued by concerned Tahsildar in Rural areas and RDO in urban areas.\nPossession is mandatory to include the property in the revenue records. Further, possession certificate is required to secure a loan.<\/li>\n<\/ul>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold pb-4 text-secondary\">Apply through e-District Portal<\/h5>\n<p class=\"text-justify text-secondary\">The applicant can follow below mentioned step by step guidelines to apply for the certificate online\nthrough the e-District portal.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 1:<\/b> Visit the main page of the e-District portal of Government of Kerala.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 2:<\/b> To avail e-District certificate services, the applicant has to register in this web portal.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold py-4 text-secondary\">Register in e-District Portal<\/h5>\n<p class=\"text-justify text-secondary\"><b>Step 3:<\/b> To register in the e-District portal, click on the \u2018Portal user registration\u2019 option from the main page.\nThe page will redirect to next page.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 4:<\/b> The applicant needs to fill personal details and select the login name and password.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 5:<\/b> Select the password recovery question and provide an answer for the selected question<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 6:<\/b> Click on validate button and further to register button.\n<span class=\"float-left w-100 my-3\"> Now the applicant can avail online certificate services by login to the e-district portal using\nthe username and password.<\/span><\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold py-4 text-secondary\">One Time Registration<\/h5>\n<p class=\"text-justify text-secondary\"><b>Step 7:<\/b> After login to the portal, do a onetime registration to apply for possession certificate.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 8:<\/b> Click on the one-time registration button. Fill all mandatory details and click on the duplicate button.<\/p>\n<p class=\"text-justify text-secondary\"><b>Note:<\/b> One-time registration process is to find out whether the applicant has already registered through any Akshaya\nCenters, i.e. duplicate check.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 9:<\/b> After the successful duplicate check, the submit button will be enabled. The applicant can click on the\nsubmit button to register.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 10:<\/b> Click on the applicant registration link, in the new page select the duplicate link, the system will\nautomatically check the duplicate application if any.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 11:<\/b> After verification, click on Submit to proceed to apply.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold py-4 text-secondary\">Enter Detail<\/h5>\n<p class=\"text-justify text-secondary\"><b>Step 12:<\/b> Enter all details for the certificate such as e-District registration number, name, certificate type and purposes.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 13:<\/b> To save details, click on the save button. The applicant will be redirected to the new page for uploading documents.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold py-4 text-secondary\">Upload Documents<\/h5>\n<p class=\"text-justify text-secondary\"><b>Step 14:<\/b> Upload all required documents (mentioned above) in PDF format with 100KB.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 15:<\/b> After uploading all required documents make payment.<\/p>\n<p class=\"text-justify text-secondary\"><b>Note:<\/b> Before making payment, check all entered data.<\/p>\n<p class=\"text-justify text-secondary\">Make Payment and Generate Receipt. The applicant can see the fee for the certificate;\nit will appear on the screen:<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 16:<\/b> The applicant can pay the fee by any of the following methods.<\/p>\n\n<div class=\"mb-4 li-data\">\n<ul>\n \t<li><b>Debit card payment<\/b><\/li>\n \t<li><b>Credit Card Payment<\/b><\/li>\n \t<li><b>IMPS<\/b><\/li>\n \t<li><b>Wallets<\/b><\/li>\n \t<li><b>Net banking<\/b><\/li>\n \t<li><b>Cash-card prepaid<\/b><\/li>\n<\/ul>\n<\/div>\n<p class=\"text-justify text-secondary\"><b>Step 17:<\/b> After successful payment of fee, the applicant can print the receipt and the certificate application.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold pb-4 text-secondary\">Download Certificate<\/h5>\n<p class=\"text-justify text-secondary\">Status of possession application will be displayed on the transaction history tab in the e-District portal\nalso the applicant will get SMS regarding the status of the application.<\/p>\n<p class=\"text-justify text-secondary\"><b>Step 18:<\/b> After receiving the \u2018Your Possession Certificate has been issued\u2019 SMS on the\nregistered mobile number, again login into the e-District portal. Download and take a print out of the digitally signed certificate.<\/p>\n<p class=\"text-justify text-secondary mb-0\">You can apply for possession certificate through Akshaya Center also<\/p>\n\n<div class=\"my-4 li-data\">\n<ul>\n \t<li><b>Latest land tax receipts<\/b><\/li>\n \t<li><b>Copy of the \u201cAadharam\u201d or Title Deed<\/b><\/li>\n \t<li><b>Location sketch<\/b><\/li>\n \t<li><b>Non objection certificate if multiple land owners are present (if any)<\/b><\/li>\n \t<li><b>Death certificate if the land deed is in the name of a late person (if any)<\/b><\/li>\n<\/ul>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold pb-4\">3. Get online approval from the local self-governing body<\/h5>\n<p class=\"text-justify text-secondary\">Application for a building permit can be made only by a licensee at the Local Self-governing\nbody (Panchayat, Municipality or Corporation) under whose jurisdiction the property falls. The licensee could be an Architect, a licensed\ndraftsman or a licensed engineer.<\/p>\n<p class=\"text-justify text-secondary\">The documents mentioned in step 1 and 2 above are then handed over to the licensee. The licensee then\napplies for an online approval for the building permit (e-filing) at the local self-governing body office.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold pb-4\">4. Acknowledgement from the local self-governing body<\/h5>\n<p class=\"text-justify text-secondary\">The application has to be acknowledged by the authorities concerned at the local self-governing body.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold pb-4\">5. Submission of the Building Permit application by a licensee<\/h5>\n<p class=\"text-justify text-secondary\">Hard copies of the following documents should be filed and submitted by the licensee.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold text-secondary\">List of documents for a Building permit application.<\/h5>\n<div class=\"mb-4 li-data\">\n<ul style=\"font-style:italic\">\n \t<li><b>Possession certificate (This is an online document)<\/b><\/li>\n \t<li><b>Latest land tax receipts<\/b><\/li>\n \t<li><b>Copy of the \u201cAadharam\u201d or Title Deed<\/b><\/li>\n \t<li><b>3 copies of the Sketch or Sanction drawing<\/b><\/li>\n \t<li><b>Copy of Architect\u2019s or Licensee\u2019s licence<\/b><\/li>\n \t<li><b>Online acknowledgment certificate issued by the local self-governing body<\/b><\/li>\n \t<li><b>Location sketch<\/b><\/li>\n \t<li><b>Non objection certificate if multiple land owners are present (If any)<\/b><\/li>\n<\/ul>\n<\/div>\n<p class=\"text-justify text-secondary\">Death certificate if the land deed is in the name of a late person (if any) &#8211; As per the Registration\nof Birth &#038; Deaths Act, 1969 every death has to be registered with the concerned State Government. Death Certificate is an important document\nissued by the Government to the nearest relatives of the deceased. A person\u2019s death in Kerala needs to be registered in the Concern Registrar\nOffice to get Death Certificate. The below-mentioned person can report or register a person\u2019s death: Documents necessary for death registration\nin Kerala are:<\/p>\n\n<div class=\"mb-4 li-data\">\n<ul style=\"font-style:italic\">\n \t<li><b>Proof of birth of the deceased \u2013 Birth certificate or SSLC certificate<\/b><\/li>\n \t<li><b>An affidavit specifying the date and time of death<\/b><\/li>\n \t<li><b>Copy of the ration card<\/b><\/li>\n \t<li><b>Application form for registration<\/b><\/li>\n \t<li><b>Medical Certification of causes of death, if required<\/b><\/li>\n<\/ul>\n<\/div>\n<p class=\"text-justify text-secondary\">Submit the file containing these documents at the local self-governing body. You should submit the\nrelevant original documents also for verification. The local self-governing body office will then issue a file number for your application.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold pb-4\">6. Verification by the Building Inspector<\/h5>\n<p class=\"text-justify text-secondary\">The Building Inspector (BI) will then visit your property, assess the veracity of the information\nprovided in your application and submit the report to the Assistant Engineer (AE).<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold pb-4\">7. Verification by the Assistant Engineer<\/h5>\n<p class=\"text-justify text-secondary\">The AE will then perform another round of verification and submit the report to the Assistant\nExecutive Engineer (AXE).<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold pb-4\">8. Approval of the application<\/h5>\n<p class=\"text-justify text-secondary\">The AExE then approves or rejects the application. For buildings up to 350 sq. m (~3700 sq. ft.),\nthis would suffice. However for larger buildings there would be higher levels of scrutiny and would require further levels of approvals.\nThis would differ from one local self-governing body to another.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold pb-4\">9. Fee payment and issue of building permit<\/h5>\n<p class=\"text-justify text-secondary\">Finally, for approved applications, you can submit the fees at the local self-governing body office.\nThe building permit will then be issued and sent to your registered address.\nThe permit fee for various construction is given below:<\/p>\n\n<div claim=\"row\">\n<div class=\"col-xl-8 col-lg-8 col-md-8 col-sm-12 m-auto\">\n<img decoding=\"async\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/cost-act_tab-1.jpg\" style=\"width:100%\">\n<p class=\"text-justify text-secondary text-center\"><b>Table 9: Permit<\/b> Fee <i>(SCHEDULE II(See Rules 9(4), 56(3),70(7), 74(3) 6 7S(4)J)<\/i><\/p>\n\n<\/div>\n<\/div>\n<p class=\"text-justify text-secondary mb-0\">Provided that in the case of residential buildings up to 150 Sq. metres of built-up area,\nthe permit fee shall be only 50 percent of the amount mentioned below.<\/p>\n<p class=\"text-justify text-secondary\">Note:- (1) Area of accessory building(s) such as car shed, toilet, cabin for watch and ward etc.\nshall be added to main building for calculating the permit fee. In the case of addition or alteration, only the area of the portion\nadded or altered shall be taken into account.<\/p>\n<p class=\"text-justify text-secondary\">(2) In the case of tourist resorts, the permit feeas stipulated in column (4) (ii) shall\nbe applicable irrespective of the structural conditions. The fee prescribed in column (5) or (6) shall not be applicable in such cases.<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold pb-4 text-secondary\">Criteria\u2019s for getting house number<\/h5>\n<p class=\"text-justify text-secondary\">Submit applications for getting house number and occupancy certificate in Town planning section of\nco-operation office<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold  text-secondary\">Documents needed<\/h5>\n<div class=\"my-2 li-data\">\n<ul>\n \t<li>House construction Completion certificate according to the plan of licensed architect or surveyor<\/li>\n \t<li>The permit obtained from the governing office before constructing the house<\/li>\n<\/ul>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold pt-4 text-secondary\">Building tax<\/h5>\n<div class=\"my-2 li-data\">\n<ul>\n \t<li>Taxes are amount of fixed percentage of rent that can be legally available if the building is rented.<\/li>\n \t<li>Taxes should be paid twice in a year as half yearly instalment. Taxes are applicable for all buildings except Central Government Institutions<\/li>\n \t<li>Building tax is not required for houses with area under 60 sq m<\/li>\n \t<li>Municipalities in Kerala are responsible for collecting Property tax.<\/li>\n \t<li>Property tax can be paid both Online as well as offline method<\/li>\n \t<li>The Kerala Property tax (Land \/ Building tax) is calculated and collected semi-annually as per assessment<\/li>\n \t<li>Property Tax is calculated as per plinth area calculation and charges vary with \u2013 Panchayat \/ Municipality \/ Corporation area.<\/li>\n<\/ul>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold pt-4 text-secondary\">Apply Online:<\/h5>\n<div class=\"my-2 li-data\">\n<ul>\n \t<li>The applicant can use online payment portal \u201cSanchaya\u201d of Kerala Government<\/li>\n \t<li>In the given page, please select \u201cCitizen Login\u201d option to go to the online service page.<\/li>\n \t<li>Please select \u201cProperty tax (Payment for Reg. Users)\u201doption to reach next page to login.<\/li>\n \t<li>If already a registered user, please login. Otherwise, create login id using new user registration option and fill the prompted\ndetails to create user id. Once logged in.<\/li>\n \t<li>The new page will have options to choose for different needs like enrol a building, Manage building list, online payment under Property tax option.<\/li>\n \t<li>Please select as per the requirement.<\/li>\n \t<li>Now we will select Manage Building List option to get a list of building enrolled.<\/li>\n \t<li>If the details are appropriate, then please hit online payment option as provided on the left hand side.<\/li>\n \t<li>The resulting screen gives list with pay now option. Please hit Pay now option to reach a new page with the details of property,\nproperty owner and relevant information about property and amount to pay.<\/li>\n \t<li>Here please hit \u201cPay Now\u201d to make payment using payment gateway.<\/li>\n \t<li>Payment gateway page will prompt user to select options ( Credit \/ Debit \/ Net Banking) to make online payment.<\/li>\n \t<li>The resulting screen will display Transaction Details. Please keep it for future reference.<\/li>\n \t<li>After successful payment you get confirmation message and online payment receipt on your registered mobile number and E- mail<\/li>\n<\/ul>\n<\/div>\n<h1 class=\"float-left w-100 pt-4 pb-4\"><span class=\"b-buttom\">National Rehabilitation and Resettlement Policy 2007<\/span><\/h1>\n<p class=\"text-justify text-secondary\">The revised National Rehabilitation and Resettlement Policy, 2007 formulated by the Ministry of\nRural Development has been approved by the Cabinet on 11th Oct., 2007 and the same has been published in the Gazette of India on 31st Oct.,\n2007.  The revised policy has been placed in the public domain at the websites of the Ministry of Rural Development and Department of\nLand Resources.<b> Some highlights of the revised policy are:<\/b><\/p>\n\n<div class=\"mb-4 li-data\">\n<ul>\n \t<li>Policy covers all cases of involuntary displacement.<\/li>\n \t<li>Social Impact assessment (SIA) introduced for displacement of 400\/200 or more families in plain\/tribal, hilly, Scheduled areas, etc.<\/li>\n \t<li>Consultations with Gram Sabhas or public hearing made compulsory;<\/li>\n \t<li>Principle of rehabilitation before displacement;<\/li>\n \t<li>If possible, land for land as compensation;<\/li>\n \t<li>Skill development support and preference in project jobs ( one person per nuclear family );<\/li>\n \t<li>Rehabilitation Grant in lieu of land\/job;<\/li>\n \t<li>Option for shares in companies implementing projects to affected families;<\/li>\n \t<li>Housing benefits to all affected families including the landless;<\/li>\n \t<li>Monthly pension to the vulnerable, such as disabled, destitute, orphans, widows, unmarried girls, etc.<\/li>\n \t<li>Monetary benefits linked to the Consumer Price Index; also to be revised suitably at periodic intervals;<\/li>\n \t<li>Necessary infrastructural facilities and amenities at resettlement areas;<\/li>\n \t<li>Periphery development by project authorities;<\/li>\n \t<li>Committees for each project, to be headed by Administrator for R &#038;R.<\/li>\n \t<li>Ombudsman for Grievance Redressal;<\/li>\n \t<li>National Rehabilitation Commission for external oversight.<\/li>\n<\/ul>\n<\/div>\n<img decoding=\"async\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/cost-act_img-1.jpg\" class=\"mt-2 mb-4\" style=\"width:100%\">\n<p class=\"text-justify text-secondary\">The revised policy covers all projects leading to involuntary displacement of people, and para 7.21\nenvisages special provisions for Scheduled Tribes and Scheduled Castes, the main  features of which are given below:-<\/p>\n\n<div class=\"mb-4 li-data\">\n<ul>\n \t<li>Consultation with the concerned gram sabha or the Panchayats at the appropriate level in the Scheduled Areas under Schedule V\nof the Constitution in accordance with provisions of the Panchayats (Extension to the Scheduled Areas) Act 1996. Each Affected family\nof Scheduled Tribe followed by Scheduled Caste shall be given allotment of land for land, if Government Land is available in\nthe resettlement Area.<\/li>\n \t<li>In case of land being acquired from the members of the Scheduled Tribes, at least one third of the compensation amount be paid at\nthe outset as first instalment and rest at the time of taking the possession of the land.<\/li>\n \t<li>Additional one time financial assistance equivalent to five hundred days minimum agricultural wages for loss of customary rights\nor usage of forest produce.<\/li>\n \t<li>Scheduled Tribes to get free of cost land for community and religious gathering, to the extent decided by the appropriate government.<\/li>\n \t<li>Scheduled Tribes affected families resettled out of district to get twenty- five percentage higher benefits in monetary terms.<\/li>\n \t<li>Scheduled Tribes and Scheduled Castes affected families to be given fishing rights in the reservoir areas of the irrigation or hydel projects<\/li>\n \t<li>Scheduled Tribes and Scheduled Castes affected families enjoying reservation benefits in the affected areas shall be entitled\nto get the reservation benefits at the resettlement areas.<\/li>\n<\/ul>\n<\/div>\n<h1 class=\"float-left w-100 pt-2 pb-4\"><span class=\"b-buttom\">The Kerala Land Assignment Rules, 1964<\/span><\/h1>\n<p class=\"text-justify text-secondary\">In exercise of the powers conferred by Section 7 of the Kerala Land Assignment Act, 1960 (Act 30 of 1960),\nand in supersession of the rules for assignment of Government lands issued under notifications I and II G.O. (Press) No. 1029\/Rev. dated 18-10-1958\npublished in the Kerala Gazette Extra Ordinary No. 107 as subsequently amended, the Government of Kerala hereby make the following Rules for the\nassignment of Government lands<\/p>\n<p class=\"text-justify text-secondary\"><b>Purposes for which land may be assigned: <\/b> Government lands may be assigned on registry for purposes\nof personal cultivation, house-sites and beneficial enjoyment of adjourning registered holdings<\/p>\n\n<div class=\"mb-4 li-data\">\n<ul>\n \t<li>The extent of Government land that shall be registered in favour of family as house site shall not exceed [twenty five cents (10 ares)].\nThe assignee shall be liable to pay land value for house sites at the rate of [Rs. 200 per acre] [40.47 Ares].]<\/li>\n \t<li>The extent of Government land that may be granted on registry when the same is indispensable required for the beneficial enjoyment of adjoining\nregistered holding 1[shall not exceed, in the case of one registered holding twenty-five cents (10.12 ares)].<br class=\"\">\n<i>[Note- (1) The authority competent to assign land for beneficial enjoyment shall be the Revenue Divisional Officer. He may pass order of assignment\nin such cases only after personally satisfying himself that the land is absolutely necessary for that purpose.]<\/i><\/li>\n \t<li>An assignment under sub-rule (2) shall be subject to the payment of market value of the land at the time of assignment and survey and\ndemarcation charges at the rates specified sub-rule (4) of rule 10 excluding the value of improvements, if any, made by the occupants on the land].<\/li>\n<\/ul>\n<\/div>\n<h1 class=\"float-left w-100 pt-2 pb-4\"><span class=\"b-buttom\">Rights of Disabled<\/span><\/h1>\n<img decoding=\"async\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/cost-act_img-2.jpg\" class=\"mb-4 mt-2 w-100\">\n<p class=\"text-justify text-secondary mb-0\"><b>Provisions for Differently-abled, Elderly and Children:-<\/b> All buildings under occupancy groups A2,\nB,C,D, E,F and J which have access to the public and all apartment buildings\/residential flats under occupancy group A1 shall be provided with the\nfollowing facilities for the differently-abled, elderly and children:<\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>(1)<\/b> Every such building shall have easy access to the main entrance through a ramp.<\/p>\n<p class=\"text-justify text-secondary\"><b>(2)<\/b> Every public building exceeding 1000 sq. metres and residential flats exceeding 2500 sq. metres built-up\narea shall have lift or separate approach through a ramp (intended for the differently-abled and elderly) to each floor. The minimum cage dimensions\nof such lift shall be as follows:<\/p>\n\n<div class=\"mb-4 li-data\">\n<ul style=\"list-style:lower-roman\">\n \t<li>Clear internal width 110 cm<\/li>\n \t<li>Clear internal depth 200 cm<\/li>\n \t<li>Entrance door width 90 cm<\/li>\n<\/ul>\n<\/div>\n<p class=\"text-justify text-secondary\"><b>(3)<\/b> The maximum gradient of any ramp approach intended for the differently-abled, elderly and\nchildren shall not exceed 1 in 12 and shall be finished with non slippery material. The minimum width of ramp shall be 120 cm. and provided\nwith handrails of 80 cm height on both sides. Minimum gap from the adjacent wall to the hand rail shall be 50mm. The slope of all such ramps\nshall be constant within a building. Entrance landing shall be provided adjacent to ramp with the minimum dimension 120 cm x 150 cm.<\/p>\n<p class=\"text-justify text-secondary\"><b>(4)Toilets:<\/b><\/p>\n<p class=\"text-justify text-secondary\">A minimum of one special water closet shall be provided for the use of the differently-abled and elderly\nwith essential provision of a wash basin at an easily accessible location with proper signage. Provided that in the case of such special toilets:<\/p>\n\n<div class=\"mb-4 li-data\">\n<ul style=\"list-style:lower-alpha\">\n \t<li>These shall be provided at the ground floor for A1, A2, B, C, D, E, F &#038; J (mentioned in building rules) occupancies and at\nevery floor in multiples of three for A2, B, C, D, E, F&#038; J occupancies.<\/li>\n \t<li>Minimum size of toilet shall be 1.50 m x 1.75 m.<\/li>\n \t<li>Minimum clear opening of the door shall be 90 cm. wide, the door shall swing out, or be sliding or folding type.<\/li>\n \t<li>Suitable arrangements of vertical\/horizontal handrails with 5cm. clearance from the wall shall be provided in the toilet.<\/li>\n \t<li>The water closet seat shall be 50 cm. above from the floor level.<\/li>\n \t<li>At least one sink in each floor shall have a knee room of 70cm. high under the sink; and<\/li>\n \t<li>Locks of such toilet doors shall be of a type that can be opened from outside in case of emergency.<\/li>\n<\/ul>\n<\/div>\n<p class=\"text-justify text-secondary\"><b>(5) Parking facilities<\/b><\/p>\n\n<div class=\"mb-4 li-data\">\n<ul style=\"list-style:lower-alpha\">\n \t<li>3% of the required parking subject to a minimum of one car space, shall be provided near the entrance, exclusively for use\nof the differently-abled with maximum travel distance of 30 metres, from the building entrance.<\/li>\n \t<li>The width of such parking bay shall be at least 3.6 metres.<\/li>\n<\/ul>\n<\/div>\n<p class=\"text-justify text-secondary\"><b>(6) Walks and paths:<\/b><\/p>\n\n<div class=\"mb-4 li-data\">\n<ul style=\"list-style:lower-alpha\">\n \t<li>Walks shall be smooth with hard level surface suitable for walking and wheeling. Avoid grates and manholes in walks. Housing, being the very basic requirement that holds the key to accelerate social\ndevelopment in many ways, the Government of Kerala launched the LIFE Mission.<\/p>\n<p class=\"text-justify text-secondary\">The target of the mission is to provide safe housing to nearly 4.30 lakhs of homeless in the State\nwithin a period of 5 years. Among the homeless, about 1.60 landless families have been historically excluded from various housing schemes\nof the past. The programme is named as LIFE (Livelihood Inclusion and Financial Empowerment) Mission and the homeless will be provided with\nmodern housing complexes with provision for pursuing their livelihoods, converging social services including Primary Health Care, Geriatric\nSupports, Skill Development and provision for financial services inclusion. Financial Assistance provided through PMAY\n(4 Lakhs) alone is not enough for the completion of construction. The beneficiary can receive an additional amount of Rs.24390\n(Rs. 271 for 90 wage days).<\/p>\n\n<h5 class=\"float-left w-100 font-weight-bold \">Credit linked subsidy scheme<\/h5>\n<p class=\"text-justify text-secondary\">The Mission, in order to expand institutional credit flow to the housing needs of urban poor will\nimplement credit linked subsidy component as a demand side intervention. Credit linked subsidy will be provided on home loans taken by\neligible urban poor (<b>EWS<\/b>\/LIG) for acquisition, construction of house.<\/p>\n\n<div class=\"mb-4 li-data\">\n<ul style=\"list-style:none\">\n \t<li>Beneficiaries of Economically Weaker section <b>(EWS)<\/b> and Low Income Group (LIG) seeking housing loans from Banks, Housing Finance\nCompanies and other such institutions would be eligible for an interest subsidy at the rate of 6.5 % for a tenure of 15 years or\nduring tenure of loan whichever is lower. The Net Present Value (NPV) of the interest subsidy will be calculated at a discount rate of 9 %.<\/li>\n \t<li>The credit linked subsidy will be available only for loan amounts upto Rs 6 lakhs and additional loans beyond Rs. 6 lakhs, if\nany, will be at nonsubsidized rate. Interest subsidy will be credited upfront to the loan account of beneficiaries through lending\ninstitutions resulting in reduced effective housing loan and Equated Monthly Instalment (EMI).<\/li>\n \t<li>Credit linked subsidy would be available for housing loans availed for new construction and addition of rooms, kitchen, toilet\netc. to existing dwellings as incremental housing. The carpet area of houses being constructed under this component of the mission\nshould be upto 30 square metres and 60 square metres for EWS and LIG, respectively in order to avail of this credit linked subsidy.\nThe beneficiary, at his\/her discretion, can build a house of larger area but interest subvention would be limited to first Rs. 6 lakh only.<\/li>\n \t<li>Housing and Urban Development Corporation (HUDCO) and National Housing Bank (NHB) have been identified as Central Nodal Agencies\n(CNAs) to channelize this subsidy to the lending institutions and for monitoring the progress of this component. Ministry may notify\nother institutions as CNA in future.<\/li>\n \t<li>Primary Lending Institutions (PLIs) can register only with one CNA by signing MoU as provided in Annexure 1.<\/li>\n \t<li>CNAs will be responsible for ensuring proper implementation and monitoring of the scheme and will put in place appropriate mechanisms\nfor the purpose. CNAs will provide periodic monitoring inputs to the Ministry of Housing and Urban Poverty Alleviation through regular\nmonthly and quarterly reports<\/li>\n \t<li>State\/UTs\/ULBs\/PLIs shall link beneficiary identification to Aadhaar, Voter card, any other unique identification or a certificate\nof house ownership from Revenue Authority of Beneficiary\u2019s native district to avoid duplication.<\/li>\n \t<li>Preference under the Scheme, subject to beneficiaries being from EWS\/LIG segments, should be given to Manual Scavengers, Women\n(with overriding preference to widows), persons belonging to Scheduled Castes\/Scheduled Tribes\/Other Backward Classes, Minorities,\nPersons with disabilities and Transgender.<\/li>\n \t<li>State Level Nodal Agency (SLNA) identified by State\/UT for implementing the mission will facilitate the identified eligible\nbeneficiaries in getting approvals and documents, etc. to avail of credit linked subsidy.<\/li>\n \t<li>For identification as an EWS or LIG beneficiary under the scheme, an individual loan applicant will submit self-certificate\/affidavit\nas proof of income.<\/li>\n \t<li>In case a borrower who has taken a housing loan and availed of interest subvention under the scheme but later on switches to another\nPLI for balance transfer, such beneficiary will not be eligible or claim the benefit of interest subvention again.<\/li>\n \t<li>Under the Mission, beneficiaries can take advantage under one component only. Since other three components are to be implemented by\nState Government through Urban Local Bodies\/Authorities etc. and this component is to be implemented by PLIs, therefore, in order that\nbeneficiaries do not take advantage of more than one component, PLIs should take NOCs quarterly from State\/UT Governments or designated\nagency of State\/UT Governments for the list of beneficiaries being given benefits under credit linked subsidy. For enabling this process,\nthe beneficiaries should be linked to his\/her Aadhaar\/Voter ID Card\/Any other unique identification Number or a certificate of house\nownership from Revenue Authority of Beneficiary\u2019s native district and State\/UT Government or its designated agency should furnish the\nNOC within 15 days of receipt of such request<\/li>\n<\/ul>\n<\/div>\n<img decoding=\"async\" class=\"w-100\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/under-miss.jpg\">\n<h1 class=\"pt-4 pb-3\"><span class=\"b-buttom\">Kerala Panchayat Building Rules, 2019<\/span><\/h1>\n<!--\n<h5 class=\"float-left w-100 font-weight-bold pt-4\">Short title, applicability and commencement:<\/h5>\n-->\n<div class=\"mb-4 li-data\">\n<ol>\n \t<li>These rules may be called the Kerala Panchayat Building Rules (KPBR), 2019.<\/li>\n \t<li>They shall apply to area under all Village Panchayats in the State.<\/li>\n \t<li>They shall come into force at once.<\/li>\n<\/ol>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold  mb-0\"><span class=\"text-secondary\">Applicability :<\/span>These rules shall apply to:<\/h5>\n<div class=\"my-4 li-data\">\n<ol>\n \t<li>Any public or private building as described below, namely:\n<ul style=\"list-style:lower-alpha\">\n \t<li>Where a building is newly erected, these rules shall apply to the designs and construction of the building;<\/li>\n \t<li>Where the building is altered, these rules shall apply to the altered portion of the building;<\/li>\n \t<li>Where the occupancy or use of building is changed, these rules shall apply to all the parts of the building affected by the change;<\/li>\n \t<li>Where addition or extension is made to a building, these rules shall apply to the addition or extension only<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold\">Essentiality of permit :<\/h5>\n<div class=\"mt-2 li-data\">\n<ol>\n \t<li>No person shall develop or redevelop any parcel of land by subdividing into plots or cause the same to be done without first obtaining\na permit for each such development or redevelopment from the Secretary.<\/li>\n \t<li>No person shall construct or reconstruct or make addition or extension or alteration to any building or cause the same to be done\nwithout first obtaining a building permit for each such work from the Secretary.<\/li>\n \t<li>No person shall change the occupancy of an existing building from one group to another, without first obtaining the permit from the Secretary.<\/li>\n<\/ol>\n<\/div>\n<div class=\"mb-4 li-data\">\n<ul style=\"list-style:none\">\n \t<li>Provided that the Secretary shall issue permit for Single family residential buildings up to 300 m2 of build-up area coming under\nCoastal Regulation Zone, in accordance with the provisions of the relevant Coastal Regulation Zone notification in force.<\/li>\n<\/ul>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold\">Permit not necessary for certain works :<\/h5>\n<p class=\"text-justify text-secondary\">Not with standing anything contained in these rules, no building permit shall be necessary for executing\nthe following works which do not otherwise violate any provisions regarding general building requirements, structural stability and fire safety\nrequirements of these rules, namely:-<\/p>\n\n<div class=\" li-data\">\n<ul style=\"list-style:lower-roman\">\n \t<li>Providing or removing of windows or doors or ventilators;<\/li>\n \t<li>Providing inter-communication doors;<\/li>\n \t<li>Providing or removing of partitions without any structural alteration;<\/li>\n \t<li>Gardening excluding any permanent structures;<\/li>\n \t<li>White or colour washing;<\/li>\n \t<li>Painting<\/li>\n \t<li>Petty repairs to the building and pitched roof;<\/li>\n \t<li>Plastering and patch work;<\/li>\n \t<li>Interior decoration without any structural alterations; and<\/li>\n \t<li>Changing of the location of the building or construction within the plot;<\/li>\n \t<li>Compound wall not abutting a public street;<\/li>\n \t<li>Huts, except huts adjacent to roads mentioned in section 235P of the Kerala Panchayat Raj Act, 1994;<\/li>\n \t<li>Single family residential buildings in Category \u2013II Village Panchayats under Group A1-Residential occupancy with total built-up area\non all floors up to 100 sq. metres (including existing and proposed within the plot) and the number of storeys limited to two.<\/li>\n<\/ul>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold  mt-2\">Transfer of plots to be intimated :<\/h5>\n<div class=\"mt-2 li-data\">\n<ol>\n \t<li>Every person holding development permit or building permit shall, unless the work has been executed in full and development or\noccupancy certificate obtained, inform the Secretary, every transfer of the whole or part of any property involved in the permit\ntogether with the name and address of the transferee and his intention to transfer or otherwise of the permit.<\/li>\n \t<li>Every person, in whose favour any property is transferred along with a development or building permit by the transferor, shall\nbefore commencing or continuing the work obtain permit of the Secretary in writing.<\/li>\n \t<li>The request for permission to commence or continue work shall be submitted in white paper along with documents, together with\ndocument regarding the ownership and possession certificate and fee of Rs100.<\/li>\n \t<li>The Secretary shall, if convinced that the transfer will not in any way badly affect the development or construction, issue\npermission in writing, transferring the permit and allowing the commencement or continuation of work, within 15 days from the\ndate of receipt of the request.<\/li>\n \t<li>Permit issued becomes invalid if part of the plot included in the approved plan is transferred \/ sold to any other person.<\/li>\n \t<li>No land development or redevelopment shall be made or no building shall be constructed on a plot notified by Gram Panchayat which is\nliable to be flooded or on a slope forming an angle of more than 45 degrees with horizontal or on soil unsuitable for percolation or on\narea shown as floodable area in any Master Plan \/ Detailed Town Planning Scheme \/ Interim Development Order in force under the Kerala\nTown and Country Planning Act, 2016 (9 of 2016)or in sandy beds, unless it is proved by the owner to the satisfaction of the Secretary\nthat construction of such a building will not be dangerous or injurious to health and the site will not be subjected to flooding or\nerosion or cause undue expenditure of public funds for providing sewers, sanitation, water supply or other public services.<\/li>\n \t<li>No construction shall be made to obstruct the natural drains and streams in a plot. Failure to comply with this instruction will\ninvite penalization under Section 51 of the Disaster Management Act, 2005 (Central Act 53 of 2005).<\/li>\n \t<li>Construct any building other than compound wall or fence or outdoor display structure within 3 meters, from any plot boundary\nabutting national highways, state highways, district roads, other roads notified by Panchayat, other un-notified roads with width 6m and above<\/li>\n<\/ol>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold  mt-2\">Occupancy of buildings :<\/h5>\n<div class=\"mb-4 li-data\">\n<ol>\n \t<li>All buildings existing or herein after proposed shall be classified, in one of the following occupancies, according\nto the use or character of occupancy namely:\u2014\n<ul>\n \t<li>Group A1- Residential<\/li>\n \t<li>Group A2 -Lodging Houses &#038; Special Residential<\/li>\n \t<li>Group B -Educational<\/li>\n \t<li>Group C- Medical\/Hospital<\/li>\n \t<li>Group D-Assembly<\/li>\n \t<li>Group E -Office<\/li>\n \t<li>Group F -Mercantile\/Commercial<\/li>\n \t<li>Group G1 -Industrial &#8211; I<\/li>\n \t<li>Group G2- Industrial &#8211; II<\/li>\n \t<li>Group H -Storage<\/li>\n \t<li>Group I -Hazardous<\/li>\n \t<li>Group J -Multiplex Complex<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/div>\n<p class=\"text-justify text-secondary\"><b>Group A1 \u2013<\/b> Residential Building shall include any building in which sleeping\naccommodation is provided for normal residential purposes, with or without cooking and\/or dining facilities. They shall include\none or multifamily dwellings, apartment buildings or residential flats. Small professional offices, small household business or\nspaces for advocates, doctors, engineers, architects, chartered accountants, beauticians, tailors, photographers, videographers,\ntelephone booth operators, computer professionals, typists, electrical or electronic equipment service professionals, not exceeding\n50 sq. metres built-up area and used as part of principal residential occupancy are also included in this group. Cr\u00e8ches, day\ncare centres, children\u2019s nurseries, reading rooms, libraries and educational buildings not exceeding 200 sq. metres of built up\narea are also included in this group.<\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>Exterior and interior open air spaces : <\/b><\/p>\n<p class=\"text-justify text-secondary\">(1) Every room intended for human habitation shall abut on an exterior or interior open space\nor veranda open to such exterior or interior open space and such open space shall be maintained for the benefit of the building\nexclusively and shall be entirely within the owner&#8217;s own premises and shall be open to the sky and is barred from being subdivided,\npartitioned or legally bifurcated or transacted, in any manner whatsoever, till such date when the structure itself is demolished\nand shall be kept free from any erection thereon other than those specially allowed in these rules. <br class=\"\">\n(2) The required minimum setbacks shall be provided at the ground level itself for the whole building.<br class=\"\">\n(3) The minimum yards for every building up to 10 meters in height shall be as per the Table given below:<\/p>\n<img decoding=\"async\" class=\"w-100\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/minimum-yard.jpg\">\n<div class=\"mb-4 li-data\">\n<ul style=\"font-style:italic\">\n \t<li>Provided that for single family residential buildings the front yard of plots abutting un-notified roads with less\nthan 6 m, shall not be less than 2 m.<\/li>\n \t<li>Provided also that for Group A1, A2 and F occupancy buildings up to two floors, any one side yard and\/or rear yard can abut\nthe boundary other than that of a street with the written consent of the adjoining land owner. If one land owner voluntarily agrees\nto abut the building in the neighbouring plot to his plot boundary, then the land owner may also have the right to abut his building\nto the same plot boundary without a written consent.<\/li>\n \t<li>Any room intended for human habitation and not abutting open air spaces on the front, rear or side shall abut on an interior\nopen space whose width shall not be less than 2.4 meters.<\/li>\n \t<li>At least 50% of the total open space in the plot shall be left unpaved or paved with suitable materials enabling percolation of rain water.<\/li>\n<\/ul>\n<\/div>\n<p class=\"text-justify text-secondary mb-0\"><b>Coverage and Floor Space Index : <\/b><\/p>\n<p class=\"text-justify text-secondary\">(1) The maximum percentage of coverage permissible for each occupancy shall limit the foot\nprint of a building. The Floor Space Index value shall limit the maximum buildable area. Floor Space Index i.e., F.S.I. shall be\ncalculated as shown below:<\/p>\n<img decoding=\"async\" class=\"w-100\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/formulla.jpg\">\n<p class=\"text-justify text-secondary mb-0\" style=\"font-style:italic\"><b>Note: &#8211; <\/b>\n(1) The area of plot to be taken for the calculation of floor space index and coverage shall be the total plot area without\ndeducting the area required from the plot for any proposed road widening stipulated in statutory Town Planning Schemes\/Plans\nunder the Town and Country Planning legislation in force, unless otherwise stipulated specifically in such schemes.<\/p>\n <img decoding=\"async\" class=\"w-100\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/coverage-table.jpg\">\n<p class=\"text-justify text-secondary\">\n(2) The percentage of coverage and the F.S.I value of buildings under different occupancies shall not exceed the maximum specified as\nin Table.<\/p>\n<p class=\"text-justify text-secondary\">\nFor apartments \/ flats under Group A1 \u2013 Residential occupancy by Government or Quasi Government agencies of Joint venture\nwith Government aimed at housing economically weaker sections (EWS) and or lower income groups (LIG) and Centrally Sponsored\nHousing Schemes for EWS, a maximum F.S.I. of 5 shall be permitted without additional fee, if built-up area of each and every\ndwelling unit in it is less than100 Sq. meters.<\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>Access : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">(1) The minimum width of access to a building and plot as well as the minimum width of\nthe existing street giving access to the plot from the main street are shown below. The width of the main street shall not be less\nthan the minimum width of access to the building and plot as well as width of street giving access to the plot.<\/p>\n<img decoding=\"async\" class=\"w-100\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/access.jpg\">\n<h5 class=\"float-left w-100 font-weight-bold  mt-2\">Parts of building<\/h5>\n<div class=\"mt-2 li-data\">\n<ul>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Mezzanine floor : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">(1) The built-up area of mezzanine floor shall not exceed one third area of the main\nfloor or room accommodating the mezzanine floor.<br class=\"\">\n(2) The clear headroom beneath and above the mezzanine floor shall not be less than 2.2 metres.<\/p>\n<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Height of room : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">The height of room intended for human entry in a building other than residential occupancy\nand livestock\/poultry farm shall not be less than 3 metres. Provided that in the case of air conditioned rooms it shall not be less\nthan 2.4 metres.<\/p>\n<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Sanitation Facilities:- <\/b><\/p>\n\n<ol>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Size of bathroom and latrine.- <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">\n(1) The area of bathroom shall not be less than 1.50 sq. Metres with either side not less than1.1m, area of a latrine shall not be\nless than 1.10 sq. metres with one side not less than 1.0 metre: Provided that the area of combined bathroom and latrine shall be\nnot less than 2.2 sq. metres with one side not less than 1. 1 metres:<br class=\"\">\n(2) The height of bathroom or latrine shall be not less than 2.20 metres.<\/p>\n<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Water closet.- <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">Every building above 50 square metres of built up area shall be provided with at least\none water closet.<\/p>\n<\/li>\n<\/ol>\n<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Staircases : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">\n(1) Any building having more than one floor shall be provided with a staircase unless each such floor is independently accessible from ground.\n(2) The number and width of stair shall be determined with respect to the occupant load as table 16 of these rules and maximum travel distance between two stairs shall not be less than 60m.\n(3) For such stair:-<\/p>\n\n<ul style=\"list-style:lower-alpha; font-style:italic;\">\n \t<li>Minimum width of stair shall be 120 centimetres,<\/li>\n \t<li>Minimum width of tread shall be 30 centimetres,<\/li>\n \t<li>Maximum height of riser shall be 15 centimetres<\/li>\n \t<li>Minimum height of handrail shall be 90 centimetres<\/li>\n<\/ul>\n<p class=\"text-justify text-secondary mb-0\">\n(4) The minimum headroom in a passage under the landing of a staircase and under the staircase shall be 2.2m.<br class=\"\">\n(5) Any building having more than three floors including basement floor(s) shall have at least two staircases, one of which may\nbe a fire escape staircase.<br class=\"\">\n(6) Escalators can be provided instead of staircases. The width of such escalators shall not be less than one metre.<\/p>\n<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Corridor, verandas and passageways : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">The clear width of any corridor, veranda or passageway in any building shall be not less\nthan 1.0 metre at any point. The width of passages giving access to the staircase shall not at any point be less than the width\nof the stair.<\/p>\n<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Lighting and Ventilation : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">(1) Every habitable room shall be furnished with sufficient number of openings such as\nwindows and ventilators affording effectual means of admission of light and air by direct communication with the external air\nor shall be sufficiently lighted and ventilated by artificial means.<br class=\"\">\n(2) No portion of a room shall be assumed to be lighted if it is more than 7.5 metres away from the opening assumed for lighting\nthat portion unless it is artificially lighted.<br class=\"\">\n(3) Windows and ventilators which open into a veranda shall be deemed to communicate with the external air, if such veranda is\nnot more than 3 metres wide and open throughout its entire length into an open space open to the sky, the width of such open\nspace being not less than 3.0 metres. Trellising, mesh, grill or net may, however, be provided on the open side of the veranda;<br class=\"\">\n(4) Every kitchen shall be ventilated according to the standards stipulated for habitable rooms and shall have suitable flue\nfor the escape of smoke and heated air unless it is provided with an approved form of smokeless installation.<br class=\"\">\n(5) Every bathroom or latrine shall be provided with sufficient light and ventilation.<\/p>\n<\/li>\n<\/ul>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold  mt-2\">Building construction under approved schemes<\/h5>\n<p class=\"text-justify text-secondary mb-0\"><b>Provision for construction under approved Schemes.-  <\/b><\/p>\n<p class=\"text-justify text-secondary\">Provisions in this chapter shall apply to construction or reconstruction or addition\nor alteration of any building in individual plots under any Government approved Schemes for economically weaker section and\nfinanced or built by Government, Panchayat, Housing Board, Scheduled Castes and Scheduled Tribes Development Corporation,\nFishermen Welfare Corporation, Matsyafed, Harijan Welfare Department, Social Welfare Department or any Government Department,\nQuasi Government Agency, or Housing Co-operative Societies. The provisions in this Chapter shall also apply to buildings\nfinanced or built by any Panchayat at any level to its beneficiaries.<\/p>\n\n<div class=\"mt-2 li-data\">\n<ul>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Area and floor restrictions : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">(1) Total floor area of each dwelling unit shall not exceed 66 sq. metres.<br class=\"\">\n(2) Number of floors shall be limited to two and a staircase room.<\/p>\n<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Setback provisions : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">(1) The minimum distance between the plot boundaries abutting any street other than\nNational Highways, State Highways, PWD roads, district roads, other roads notified by Panchayat, other roads with width 5m and\nabove and the building, other than a compound wall or fence or outdoor display structure, shall be minimum 1.50 metres.<br class=\"\">\n(2) Front yard shall have minimum 1.00 metre width.<br class=\"\">\n(3) In the case of individual developed plots requiring no lay out approval from the District Town Planner, there shall be\naverage 60 centimetres open space on the sides and the rear: Provided that no door shall be allowed on any portion, if that\nportion does not have minimum 1 metre open yard.<br class=\"\">\n(4) In the case of buildings requiring layout approval of District Town Planner, the side yards and rear yard shall\nbe provided as shown in the building layout:<br class=\"\"><br class=\"\"><\/p>\nProvided that no portion of the building shall encroach, project or overhang beyond the plot boundaries.<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Certain provisions not to apply : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\"><\/p>\n<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Mezzanine : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">Provisions regarding F.S.I., coverage, off-street parking space, access width,\nheight restriction with regard to width of road and the yard abutting the road, dimensions with regard to building parts, light\nand ventilation shall not apply to building under this chapter.<\/p>\n<\/li>\n \t<li>\n<p class=\"text-justify text-secondary mb-0\"><b>Application for permit and its disposal : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">(1) Where the construction or reconstruction or addition or alteration is proposed to be\ndone by individuals separately, an application in white paper, typed, or written in ink and affixed with necessary court fee stamp\nshall be submitted by the individual concerned to the Secretary, along with a site plan showing proposed building footprint and\ndocument to prove his ownership. The number of floors and the area in each floor shall be specified in the application.<br class=\"\">\n(2) Secretary shall, if convinced of the boundaries and bonafides of the ownership and that the building is in accordance with the\nrules in this Chapter, issue permit.<br class=\"\">\n(3)There shall be no application fee in the case of individual application and the permit fee in the case\nof individual application<br class=\"\">\n(4) Where the construction or reconstruction or addition or alteration is proposed to be done by the Department, Corporation, Board, Agency, Local Self Government Institution or Society themselves, layout for sub-division shall be obtained from the Secretary and no building permit is necessary.<\/p>\n<\/li>\n<\/ul>\n<\/div>\n<img decoding=\"async\" class=\"w-100\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/building-app.jpg\">\n<h1 class=\"pt-4 pb-3\"><span class=\"b-buttom\">Kerala Municipality Building Rules, 2019<\/span><\/h1>\n<p class=\"text-justify text-secondary mb-0\"><b>Short title, applicability and commencement : <\/b><\/p>\n\n<div class=\"mt-2 li-data\">\n<ol>\n \t<li>These rules may be called the Kerala Municipality Building Rules, 2019.<\/li>\n \t<li>They shall apply to area under all Municipalities in the State.<\/li>\n \t<li>They shall come into force at once.<\/li>\n<\/ol>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold  mb-0\"><span class=\"text-secondary\">Applicability :<\/span>These rules shall apply to:<\/h5>\n<div class=\"my-4 li-data\">\n<ol>\n \t<li>Any public or private building as described below, namely:\n<ul style=\"list-style:lower-alpha\">\n \t<li>Where a building is newly erected, these rules shall apply to the designs and construction of the building;<\/li>\n \t<li>Where the building is altered, these rules shall apply to the altered portion of the building;<\/li>\n \t<li>Where the occupancy or use of building is changed, these rules shall apply to all the parts of the building affected by the change;<\/li>\n \t<li>Where addition or extension is made to a building, these rules shall apply to the addition or extension only:<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/div>\n<p class=\"text-justify text-secondary\">Provided that, for calculation of Floor Space Index, coverage, required off street parking\narea to be provided and width of access to the plot as well as minimum width of the street giving access to the plot from the\nmain street, the whole building existing to be retained and proposed shall be taken into account;\nProvided further that the addition, extension or new building shall be permitted only if the site and existing buildings\nare authorised.<\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>Essentiality of permit : <\/b><\/p>\n<p class=\"text-justify text-secondary\"> (1) No person shall develop or redevelop any parcel of land by subdividing into plots or\ncause the same to be done without first obtaining a permit for each such development or redevelopment from the Secretary.<br class=\"\">\n(2) No person shall construct or reconstruct or make addition or extension or alteration to any building or cause the same to\nbe done without first obtaining a building permit for each such work from the Secretary.<br class=\"\">\n(3) No person shall change the occupancy of an existing building from one group to another, without first obtaining the permit\nfrom the Secretary.<\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>Application for development\/building permit : <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\">(1) Every person other than a Central or State Government Department who intends to:\u2014<\/p>\n\n<div class=\"my-4 li-data\">\n<ul style=\"list-style:lower-alpha\">\n \t<li>Develop or redevelop any parcel of land by subdividing into plots shall apply in writing to the Secretary in the form<\/li>\n \t<li>Construct or reconstruct a building or make alteration or addition or extension or change in occupancy to a building\nshall apply in writing to the Secretary in the form Provided that the Secretary shall issue permit for Single family\nresidential buildings up to 300 m2 of build-up area coming under Coastal Regulation Zone, in accordance with the provisions\nof the relevant Coastal Regulation Zone notification in force.<\/li>\n<\/ul>\n<\/div>\n<p class=\"text-justify text-secondary mb-0\"><b>Permit not necessary for certain works : <\/b>Not withstanding anything contained in\nthese rules, no building permit shall be necessary for executing the following works which do not otherwise violate any provisions\nregarding general building requirements, structural stability and fire safety requirements of these rules, namely:-<\/p>\n\n<div class=\"my-4 li-data\">\n<ul style=\"list-style:lower-roman; font-style:italic;\">\n \t<li>Providing or removing of windows or doors or ventilators;<\/li>\n \t<li>Providing inter-communication doors;<\/li>\n \t<li>Providing or removing of partitions without any structural alteration;<\/li>\n \t<li>Gardening excluding any permanent structures;<\/li>\n \t<li>White or colour washing;<\/li>\n \t<li>Painting;<\/li>\n \t<li>Petty repairs to the building and pitched roof;<\/li>\n \t<li>Plastering and patch work;<\/li>\n \t<li>Interior decoration without any structural alterations; and<\/li>\n \t<li>Changing of the location of the building or construction within the plot<\/li>\n \t<li>Compound wall not abutting a public street<\/li>\n<\/ul>\n<\/div>\n<h5 class=\"float-left w-100 font-weight-bold  mt-2\">General provisions regarding site and building requirements<\/h5>\n<p class=\"text-justify text-secondary mb-0\"><b>General requirement regarding plot : <\/b><\/p>\n<p class=\"text-justify text-secondary \">(1) No land development or redevelopment shall be made or no building shall be constructed\non any plot on any part of which there is deposited refuse, excreta or other offensive matter which in the opinion of the Secretary\nis considered objectionable, until such refuse, excreta or other offensive matter has been removed there from and the plot has\nbeen prepared or left in a manner suitable for land development or building purpose for the satisfaction of the Secretary.<br class=\"\">\n(2) No land development or redevelopment shall be made or no building shall be constructed on a plot, which comprises or\nincludes a pit, quarry or other similar excavation or any part thereof unless such plot has been prepared or left in a manner\nor condition suitable for land development or redevelopment or building purposes to the satisfaction of the Secretary.<br class=\"\">\n(3) No land development or redevelopment shall be made or no building shall be constructed on a plot notified by the Municipality\nwhich is likely to be flooded or on a slope forming an angle of more than 45 degrees with horizontal or on soil unsuitable for\npercolation or on area shown as floodable area in any Master Plan \/ Detailed Town Planning Scheme \/<br class=\"\">\nInterim Development Order in force under the Kerala Town and Country Planning Act, 2016 (9 of 2016) or in sandy beds, unless it is\nproved by the owner to the satisfaction of the Secretary that construction of such a building will not be dangerous or injurious\nto health and the site will not be subjected to flooding or erosion or cause undue expenditure of public funds for providing\nsewers, sanitation, water supply or other public services.<br class=\"\">\n(4) No construction shall be made to obstruct the natural drains and streams in a plot. Failure to comply with this instruction will\ninvite penalization under Section 51 of the Disaster Management Act, 2005 (Central Act, 53 of 2005).<br class=\"\">\n(5) No building or part of a building shall be constructed or reconstructed or no addition or alteration shall be made to any\nexisting building in the intervening spaces between the building and any overhead electric supply line as described in the Table\n2 below and as specified in the Indian Electricity Rules as amended from time to time.<br class=\"\">\nProvided that single storied buildings shall be allowed even if the above mentioned clearance is not available, if the applicant\nproduces a no objection certificate from the Chief Electrical Inspector or an officer authorized by him, before issue of permit.<\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>Prohibition for constructions abutting public roads : <\/b><\/p>\n<p class=\"text-justify text-secondary \">(1) No person shall construct any building other than compound wall or fence or outdoor\ndisplay structure within 3 meters, from any plot boundary abutting national highways, state highways, district roads, other roads\nnotified by Municipality, other un-notified roads with width 6 m and above:\nProvided that ramps or bridges or steps or similar structures, all open to sky, with or without parapets or railings shall\nbe permitted as access from the street to the building only in such cases where the level difference between the street and\nthe plot does not permit natural access to the building. Cornice roof or weather shade, not exceeding 75 cms shall be permitted\nto project from the building into such 3 metres. In no case, access to more than one floor can be provided within these 3 metres.<\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>Height of buildings : <\/b><\/p>\n<p class=\"text-justify text-secondary \">(1) The maximum height of any building or part thereof shall be limited according to the\nwidth of the street as follows <br class=\"\">\n(a) The maximum height of the building or part thereof shall not exceed twice the width of the street abutting the plot plus\ntwice the width of the yard from the building to the abutting street;<br class=\"\">\n(b) If a building plot abuts on two or more streets of different width, the building plot shall be deemed to abut the street\nthat has the greater width for the purposes of this rule and the height of the building shall be regulated by the width of that\nstreet and shall be continued at this height along the narrower street:<\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>Occupancy of buildings : <\/b><\/p>\n<p class=\"text-justify text-secondary \">(1) All buildings existing or herein after proposed shall be classified, in one\nof the following occupancies, according to the use or character of occupancy namely:\u2014<\/p>\n\n<div class=\"mb-4 li-data\">\n<ol>\n \t<li>All buildings existing or herein after proposed shall be classified, in one of the following occupancies, according\nto the use or character of occupancy namely:\u2014\n<ul>\n \t<li>Group A1- Residential<\/li>\n \t<li>Group A2 -Lodging Houses &#038; Special Residential<\/li>\n \t<li>Group B -Educational<\/li>\n \t<li>Group C- Medical\/Hospital<\/li>\n \t<li>Group D-Assembly<\/li>\n \t<li>Group E -Office<\/li>\n \t<li>Group F -Mercantile\/Commercial<\/li>\n \t<li>Group G1 -Industrial &#8211; I<\/li>\n \t<li>Group G2- Industrial &#8211; II<\/li>\n \t<li>Group H -Storage<\/li>\n \t<li>Group I -Hazardous<\/li>\n \t<li>Group J -Multiplex Complex<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/div>\n<p class=\"text-justify text-secondary\"><b>Group A1 \u2013  <\/b>Residential Building shall include any building in which sleeping\naccommodation is provided for normal residential purposes, with or without cooking and\/or dining facilities. They shall include\none or multifamily dwellings, apartment buildings or residential flats. Small professional offices, small household business or\nspaces for advocates, doctors, engineers, architects, chartered accountants, beauticians, tailors, photographers, videographers,\ntelephone booth operators, computer professionals, typists, electrical or electronic equipment service professionals, not exceeding\n50 sq. metres built-up area and used as part of principal residential occupancy are also included in this group. Cr\u00e8ches, day care\ncentres, children\u2019s nurseries, reading rooms, libraries and educational buildings not exceeding 200 sq. metres of built up area are\nalso included in this group.<\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>Land sub-division and plot development :  <\/b><\/p>\n<p class=\"text-justify text-secondary mb-0\"><b>1. for residential use:\u2014  <\/b><\/p>\n<p class=\"text-justify text-secondary\">All new land subdivisions and plot developments shall be subject to the following,\nnamely:\u2014<br class=\"\">\n(i) the area of any newly subdivided plot, reconstituted plot or building plot shall be not less than 125 sq. metres with an average\nwidth of 6metres: Provided that for row housing where side open spaces are not required, it is sufficient if the plot has an average\nwidth of 4.5 metres;<br class=\"\">\n(ii) every plot shall have a frontage of not less than 4 metres on any abutting street;<br class=\"\">\n(iii) Every street in the layout shall have not less than 7 metres width and shall be motorable;<br class=\"\"><br class=\"\"><\/p>\nProvided that in the case of cul-de-sacs with length not exceeding 250 metres it is sufficient if the street (cul-de-sac)\nhas not less than 5metres width;\n<br class=\"\"><br class=\"\">\nProvided further that in residential areas where motorable street cannot be made due to difficult terrain, the width of any new\nstreet shall not be less than 5 metres and where the length of such street does not exceed 250 metre it is sufficient if the\nstreet has not less than 3metres width.\n\n<img decoding=\"async\" class=\"w-100 my-4\" src=\"http:\/\/cdp.habitatindia.net\/\/wp-content\/uploads\/2021\/07\/land-sub.jpg\">\n\n<\/div>\n<\/div>\n<\/div>\n<\/div>","protected":false},"excerpt":{"rendered":"Housing acts and rules: Construction, land and ownership 1.
